CloudFran SiteBuilder Product Addendum (Websites, Hosting, E-commerce, AI Content)

This Addendum supplements the CloudFran Terms of Service and is incorporated by reference into the Master Services Agreement. The Unified Payments + Marketplace Addendum also applies to payment-related features.

1. Scope

This Addendum governs the use of CloudFran SiteBuilder, including website creation, hosting, content management, and integrated e-commerce functionality.

2. Platform Role

CloudFran provides hosting and site-building tools. Users are solely responsible for the content, operation, and compliance of their websites.

3. Content Responsibility

Users are responsible for all content published on their sites, including accuracy, legality, and compliance with applicable laws.

4. AI-Generated Content Disclaimer

Content generated by AI tools may require human review. CloudFran does not guarantee accuracy, legality, or suitability.

5. E-commerce and Payments

Users may sell goods or services through their sites. All transactions are subject to CloudFran fees (3.75% + $0.75) and are processed via integrated payment providers.

6. Chargebacks and Disputes

CloudFran mirrors payment processor protections, including $15 dispute fees. Users are responsible for chargebacks and associated losses.

7. Prohibited Content

Users may not host illegal, harmful, or infringing content. CloudFran may remove such content at its discretion.

8. Third-Party Integrations

SiteBuilder may integrate with third-party services (e.g., Stripe). CloudFran is not responsible for third-party performance or compliance.

9. Data and Privacy

User and customer data are governed by the Privacy Policy and DPA. Users act as data controllers for their site visitors.

10. Uptime and Availability

CloudFran aims for high availability but does not guarantee uninterrupted service.

11. Liability

CloudFran is not liable for website content, outages, lost revenue, or customer disputes.

12. Governing Law

This Addendum is governed by Delaware law with Georgia enforceability considerations.

13. Compliance

CloudFran aligns with SOC2, hosting best practices, and audit readiness standards.
